📜 Terms of Service & End-User License Agreement

1. Binding Legal Agreement

By downloading, installing, browsing, accessing, or registering on the Bed Space Manager mobile application or web portal (https://findbedspace.online), you ("User", "Room Admin", "Room Member", or "Visitor") enter into a legally binding contract with Future Skills Technologies ("the Company", "we", "us", or "our"). If you do not unequivocally agree to all terms, disclaimers, and liability waivers contained herein, you are strictly prohibited from using the platform.

2. Absolute Disclaimer Regarding Real Estate, Subletting & GCC Municipal Laws

Shared living, bachelor housing, bed space occupancy, and subleasing arrangements are strictly governed by municipal decrees, civil housing codes, building management regulations, and public health laws across the member states of the Gulf Cooperation Council (GCC), including the United Arab Emirates (UAE), Kingdom of Saudi Arabia (KSA), Qatar, Kuwait, Oman, and Bahrain.

• Zero Physical Ownership or Authority: Future Skills Technologies does not own, lease, operate, manage, inspect, or endorse any apartment, room, villa, building, or bed space listed or tracked through this software.
• Sole User Compliance Obligation: It is the sole, exclusive, and unassigned responsibility of the Room Administrator and Room Members to ensure that their physical living arrangements fully comply with all municipal occupancy caps, family-zone restrictions, building management contracts, Ejari/Tawtheeq registration rules, and local fire safety codes.
• No Creation of Tenancy Rights: The registration of a room workspace, the assignment of a bed slot, or the generation of a calculation statement within the App does NOT constitute, prove, or imply any lawful lease, tenancy right, or sublease entitlement.
• Total Immunity Against Municipal Penalties & Evictions: Future Skills Technologies shall bear ABSOLUTE ZERO LIABILITY for any municipal raids, property lockouts, municipal fines, electricity disconnections, landlord disputes, civil lawsuits, or evictions arising from occupants' physical tenancy arrangements. Any and all governmental or regulatory penalties are solely the personal liability of the physical occupants.

3. Complete Financial & Transactional Disclaimers

• Zero Money Transmission: The platform does NOT process, transmit, collect, hold, clear, or escrow real fiat currency. All monetary transfers—including cash payments, bank deposits, exchange house remittances, and digital wallet transfers—occur strictly peer-to-peer (P2P) directly between occupants outside of the platform.
• Algorithmic Utility Only: The App operates purely as a mathematical calculator based on parameters entered by users. Future Skills Technologies is not liable for financial discrepancies, ledger mismatches, inaccurate date counts, or mathematical errors resulting from incorrect data entry, forged receipts, or user deception.
• Zero Dispute Arbitration: Conflicts concerning unreturned security deposits, unpaid rent, utility overcharges, room expulsions, or financial theft are strictly external civil disputes. Future Skills Technologies has zero legal obligation to investigate, mediate, intervene, or arbitrate any dispute between roommates or property managers.

4. Criminal Activity, Immigration & Conduct Disclaimer

• No Identity or Background Verification: Future Skills Technologies does not execute criminal record checks, residency visa validations, police background screenings, or immigration status audits on users. Room Admins and residents must independently verify the identity, Emirates ID/National ID, and legal residency status of anyone they admit into their shared accommodation.
• Zero Tolerance for Illegal Operations: Users are strictly prohibited from utilizing the App or public directory to facilitate money laundering, prostitution, unauthorized commercial lodging, human trafficking, unlicensed visa trading, absconding sheltering, drug distribution, or unlawful assembly.
• Independent Criminal Liability: Any criminal act, civil wrong, property damage, bodily harm, theft, or regulatory violation committed by an occupant or visitor within a physical residence is solely the individual liability of the perpetrator. Future Skills Technologies disclaims all liability for the conduct of individuals using the software.

5. User Roles & System Logic Governance

A. Room Administrators

The Room Admin warrants that they possess legitimate authority among their co-residents to manage the room ledger. The Admin is solely responsible for verifying the accuracy of expense receipts, inputting honest billable days, and executing month-end settlements.

B. Profile Verification Lock

To prevent identity fraud, protect roommate security, and maintain ledger auditability, once a resident submits their profile information and the Room Admin approves it, the profile editing permissions are locked. Alterations or data anonymization must be authorized directly by the Room Admin.

C. Guest Hosting & Visitor Responsibility

If a resident logs an external guest via the Guest Tracker, the hosting roommate ("Host") assumes 100% legal, financial, and behavioral responsibility for that guest. All guest stay charges are billed directly and exclusively to the Host member's account.

6. Public Listing Marketplace (FindBedSpace.online)

The optional public room advertising board allows Room Admins to announce vacant bed spaces. Room seekers and Room Admins interact entirely at their own risk. Future Skills Technologies makes no representations regarding the physical condition, safety, cleanliness, or legal compliance of any listed space. Physical inspection and contract verification are strictly the user's duty prior to any financial commitment.

7. Comprehensive Indemnification (User Protection of Company)

YOU EXPRESSLY AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS Future Skills Technologies, its founder, software developers, affiliates, directors, officers, and contractors from and against any and all claims, liabilities, damages, losses, governmental fines, municipal penalties, legal judgments, and attorney fees arising out of or related to:

1. Your use or misuse of the Bed Space Manager application or FindBedSpace.online website;
2. Any breach of local tenancy, subleasing, or residential municipal regulations in your host country;
3. Any interpersonal dispute, rent default, or financial altercation between you and your roommates or landlords;
4. Any property damage, personal injury, health hazard, or criminal incident occurring at your physical accommodation.

8. Limitation of Liability & "AS-IS" Warranty

The platform is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind. Under no statutory circumstances shall Future Skills Technologies be liable for direct, indirect, incidental, punitive, special, or consequential damages resulting from lost profits, data corruption, cloud server downtime, eviction losses, or financial disputes. In any jurisdiction where liability cannot be entirely excluded, the Company's maximum aggregate liability shall not exceed the total subscription fee paid by the user to the Company in the preceding three (3) months, or $20 USD, whichever is lower.

9. SaaS Subscriptions & Platform Licenses

Fees paid to Future Skills Technologies for software access licenses (such as elevated member capacities, PDF exports, and cloud backups) are strictly non-refundable and non-transferable once service has commenced.

10. Governing Law & Dispute Jurisdiction

These Terms shall be interpreted and governed in accordance with the substantive laws of the Republic of India, without regard to conflict of law principles. Any legal suit, arbitration, or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kasaragod, Kerala, India.
